$3.15 Million Settlement Reached in Azura Vascular Care Data Breach Case
A $3.15 million settlement has been reached with Fresenius Vascular Care, Inc., operating as Azura Vascular Care, following a data breach that potentially exposed sensitive patient information between September 27 and October 9, 2023.
According to RG/2 Claims Administration LLC, the appointed Settlement Administrator, unauthorized third parties potentially gained access to personal information including names, addresses, birth dates, Social Security numbers, driver’s license details, medical records, insurance information, and treatment data.
The settlement establishes a fund for individuals whose information was compromised in the breach. Those affected, who should have received notification of the incident, may qualify for compensation in one of two ways:
- Documented Loss Payment: Eligible class members can submit claims with supporting documentation for actual losses related to the breach, with compensation of up to $10,000.
- Pro Rata Cash Fund Payment: Alternatively, affected individuals can opt for a flat cash payment without providing documentation. The amount will depend on the number of valid claims and remaining funds after documented loss payments.
To receive benefits, class members must submit a valid claim form by June 30, 2025. Those who wish to exclude themselves from the settlement, preserving their right to pursue separate legal action, must do so by May 30, 2025. The same deadline applies for filing objections to the settlement terms.
The U.S. District Court for the Eastern District of Pennsylvania has scheduled a Final Approval Hearing for June 16, 2025, at 11:00 a.m. before Judge Michael M. Baylson to consider approving the settlement and related matters.
